Privacy policy

My VIP Travel respects your privacy and is committed to protecting your personal information. This policy describes My VIP Travel practices regarding personally identifiable information or personal data (“personal information/ PI”). This policy applies to our websites, applications, email, voice calls and text messages, and social media accounts (the “Platforms”). When you use the Platforms, you agree to the terms in this policy.

PURPOSE OF THIS PRIVACY POLICY

This privacy policy aims to give you information on how My VIP Travel collects and processes your PI, including any PI you may provide through the Platforms when you purchase a product or service or sign up for our newsletter.

It is important that you read this privacy policy together with any other privacy policy, notice, or fair processing policy we may provide on specific occasions when we are collecting or processing PI about you so that you are fully aware of how and why we are using your PI. This privacy policy supplements other notices and privacy policies and is not intended to override them.

My VIP Travel is the company (business) responsible for your PI.

We have appointed a Data Protection Officer (DPO) who is responsible for overseeing questions in relation to this privacy policy. If you have any questions about this privacy policy, please contact the DPO using the details set out below.

POLICY AMENDMENTS

We keep our privacy policy under regular review updating it as needed. My VIP Travel might make minor amendments to this Privacy policy which shall not adversely affect your privacy, except if laws set otherwise.

In case of material changes My VIP Travel will definitely publish such amendments and amended policy on our website and, as far as possible, notify you either by email or by pop-up windows when you are using our Platforms next time.

Amendments shall enter into force on the Effective Date.

The actual version of the Privacy policy is published on our website.

DATA ACCURACY

When you give us PI, you are telling us, that the information is true, accurate, complete, and current. You are also telling us, that you have the authorization to provide it to us.

It is important that the PI we hold about you is accurate and current. Please keep us informed, if your PI changes during your relationship with us.

THE CATEGORIES OF PERSONAL INFORMATION WE COLLECT

We may collect, use, store, and transfer different kinds of PI about you which we have grouped together as follows:

Identifiers or Identity Data such as a first/ middle/ last name, alias, postal address, unique personal identifier (cookie), date of birth, online identifier Internet Protocol address, or other similar identifiers.

Commercial Information, including requested price quotes, products or services purchased or other purchasing or consuming histories or tendencies, as well as Financial Data (bank account and payment card details) and Transaction Data (details about payments to and from you and other details of products and services you have purchased from us).

Network Activity Information, including, but not limited to Technical Data (your login data, browser type and version, browsing history, search history, time zone setting and location, browser plug-in types and versions, operating system and Platform, and other technology on the devices you use to access our Platforms), and information regarding your interaction with our Platforms (Usage Data).

Geolocation data (country, state or city).

Audio (e.g. call records) and Electronic (e.g. email threads) information.

Inferences (conclusions) drawn from any of the PI collected by My VIP Travel, including, but not limited to Profile Data (your preferences, characteristics, psychological trends, behavior, attitudes, intelligence, feedback and survey responses) and Marketing Data (your preferences in receiving marketing from us and our partners and your communication preferences).

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your PI, but is not considered PI in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Network Activity Information to calculate the percentage of users accessing a specific Platform feature. However, if we combine or connect Aggregated Data with your PI, so that it can directly or indirectly identify you, we treat the combined data as PI which will be used in accordance with this privacy policy.

Customer support If you choose to contact our customer support services we will collect any inquires, complaint or other information that you may submit to our support team.

We do not collect any Special Categories of PI about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

CHILDREN

My VIP Travel does not knowingly collect PI from minors, except if the minor is one of the travelers. If we become aware that a minor is attempting to submit PI, we will remove this information from our records. If you are the parent/legal guardian of a minor who has given us PI, please contact us so we can delete it.

IF YOU FAIL TO PROVIDE PERSONAL INFORMATION

Where we collect PI required by law or under the terms of a contract, and you fail to provide that PI when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.

HOW WE COLLECT YOUR PERSONAL INFORMATION

We use different methods to collect PI from and about you including through:

PI you give to us

We collect your PI directly from you (using life chat, online forms or via voice call/ messenger). Any contact data (emails, phones etc.) provided by you throughout any interaction will be treated as your personal contacts and saved in your profile for future communications unless specifically requested not to be stored (one-time communication only). For example, when you provide us with your PI by requesting a quote, registering or booking travels, contacting our customer support. This includes PI you provide when you:

apply for our products or services;

subscribe to our service or publications; request marketing to be sent to you; give us feedback or contact us.

When we chat with you (e.g. WhatsApp, Facebook, regular SMS etc.) the chat might be accidentally closed/ removed, there might be interruptions, slow internet connection etc. We may contact you later via automated phone and text messages or email (if available) in order to restore our communication started within the chat. No purchase necessary. You can opt out from further communication by replying to SMS / email or notifying us during the phone call.

One of the main collection methods are VOICE CALLS We have vested interest to ensure you have chosen the best possible option. Voice calls are an exclusive opportunity to provide you with an immediate customer support and disclose additional product features, you might not notice on website. Usually, we call back on your request. Sometimes there might be unfinished conversations regarding current flights (misunderstanding in live chat, email system error, poor internet connection etc.), which require immediate response. We don’t make unwanted telemarketing robocalls or any annoying advertising campaigns. You can opt-out this communication any time by contacting us via phone or email.

PI we collect passively We also collect your PI passively. For example, we collect information about you over time and across different Websites when you visit the Platform. We also use tracking tools like cookies and beacons. As you interact with our Platforms, we will automatically collect Network Activity Information about your equipment, browsing actions and patterns. We collect this PI by using cookies and other similar technologies. For additional information, please, refer to our Cookie policy. Platform features may make use of your device attributes and settings that will allow us to determine your physical location (country, state). Such technologies may include IP address mapping or other technologies. We use this information to enhance and personalize your experience and provide you with offers and services that may be of interest to you. My VIP Travel does not have control over your device settings, but we do recommend enabling location services on your device so you can take advantage of the location-based features and functionality offered.

PI we receive from service providers: We collect your PI using service providers. This can include when you log in using a service provider platform, such as Facebook. In addition, we also integrate service providers’ software that collects information about users for security reasons.

FOR WHAT PURPOSE WE USE YOUR PERSONAL INFORMATION

We will use your PI for the following purposes:

Improving our services to provide you and improve our Platforms and services, to better understand the users of our Platforms and services, and to protect our property and to prevent damage to them.

Regular customers

If you have ever requested a price quote or purchased our services, we treat you as the Regular (loyal) Customer. Regular Customers have plenty of benefits:

become experts of using our services;

receive the most relevant price quotes.

According to our policy, we may contact you as a Regular Customer via email/phone saved within previous requests and transactions. Such cases may be, for example, when you accidentally provided the wrong email/phone or when you cannot be reached via email/ phone left in the last request/ purchase. If you want to opt-out, please contact us.

Bookings We and our travel partners use your PI to process your bookings and store your itinerary information where applicable.

Marketing activities

We use your information for marketing purposes. These activities may include:

To send you marketing emails and/or text messages from My VIP Travel address regarding our services or those of our partners, if you have opted-in to receive emails and/or text messages from us or have transacted with us, and as permitted by law. You can easily unsubscribe from these marketing communications at any time by clicking on the “Unsubscribe” link included in the newsletter or by texting STOP via SMS.

To display more relevant advertising and recommendations, or suppress advertising and content that you might find irrelevant. This advertising might be shown to you on our Platforms as well as third party platforms (including Google and social media sites like Facebook) and include information or offers that we, or our business partners’, believe you will find interesting. Individualized advertising may be based on information collected through cookies or other tracking technologies. You can opt out from Google (press here) and Facebook (press here) ad personalization any time.

If you choose to participate in promotional activities, relevant information may be used to administer these promotions.

If you participate in our Referral Program and forward an email with referral Code to your friends we presume that you will respect any objections received from your friends regarding their email processing for marketing purposes. If you keep ignoring friends’ objection and don’t report it to us we disclaim all responsibility which may be imposed on us as an advertiser. My VIP Travel won’t unsubscribe friends’ email if it was not specifically requested by them.

To communicate with you, including as follows:

To send booking confirmations;

To send alerts and notifications you have subscribed to, including to your mobile device;

To solicit reviews;

To update you regarding itineraries processed by our service;

To communicate with you if you have contacted My VIP Travel customer support;

To send you information servicing and administrative emails;

To send you information about services, offered by My VIP Travel or our business partners, that we believe you would be interested in;

Legal purposes in certain cases we may need to use your information to handle and resolve legal disputes, for regulatory investigations and compliance or to enforce the terms of use of the service.

Performance of a contract the use of your PI may be necessary to perform the services and provide you products that you have requested from us. For example, if you make a booking on our Platform, we need to collect PI from you in order to complete the booking.

Membership management If you book air tickets or related travel products using our services, we offer you to manage all your booking information within online account (cabinet).

You will also be able to see historical data, your referral discounts and other bonuses according to the terms of use of the account. You are entitled to delete the account any time.

Consent We may rely on your consent to use your PI for certain direct marketing purposes. You can withdraw your consent anytime by contacting us.

We have set out below, in a table format, a description of all the ways we plan to use your PI.

  • To comply with the requirements of licenses, registrations and permissions obtained by My VIP Travel, including industry standards (airline safety rules, PCI DSS etc.)

  • To comply with requests, subpoenas and other enforcement notices issued by regulators, courts and law enforcement agencies

CHANGE OF PURPOSE

We will only use your PI for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

YOUR CHOICES

As a customer-oriented business we respect and value your expectations.

As a result, you are able to make announcements and queries at any time regarding your concerns in privacy matters.

Each of our marketing email has an opt-out button and you can unsubscribe from such communication at any time. You cannot unsubscribe from servicing emails and administrative messages.

HOW WE SHARE YOUR PERSONAL INFORMATION

Corporate affiliates and change of control We may share your PI with our corporate affiliates and if My VIP Travel itself (or part of its business) is sold or otherwise changes control, owners would have access to your PI for the uses set out herein.

Service providers We may share your PI with suppliers who perform services on our behalf and have agreed in writing to protect and not further disclose your information.

Payment service providers and travel vendors If you book through the Platforms, we may share your PI with the payment service providers, acquirer banks and the travel vendors you have booked with. This can include online travel agencies, hotels, airlines, car rental companies, and travel insurance providers. These third parties will process your PI as data controllers in accordance with their own privacy policies. If you contact our customer support, they may need to share information about your request with the relevant travel vendor in order to assist you.

Business partners We may share your PI with various business partners. Some of these business partners may use your PI for fraud detection, including, but not limited Identifiers, Contact Data and Network Activity Information, also to detect, prevent, or otherwise address fraud, security or technical issues. We may also share your PI to ask our partner to create a survey, form, application, or questionnaire, so we know the degree of your satisfaction with our services. Some of these business partners may use your PI for online behavioral advertising purposes, or to offer you services or products that we believe you may be interested in. We may also share your information as otherwise described to you at the time of collection. We may also share anonymous aggregated usage information with partners.

We enter into confidentiality and PI processing terms with partners to ensure they comply with high levels of confidentiality and best practice in privacy and security standards and we regularly review these standards and practices.

Trips shared by you If you use or have itineraries as part of our Service, you can send or grant access to your itinerary to anyone you choose. Your itinerary may contain enough details (for example, booking reference codes) to allow the recipient to cancel or modify your booking, perform a check-in, etc. You should only share your itinerary with people you trust. If you choose to display your itinerary on publicly-viewable web pages (Facebook, for instance), that information may be collected and used by others.

Information shared in public If you provide us a review of your trip, you authorize us to publish it on all our Platforms under the screen name you provided. You also authorize us to aggregate it with other reviews.

Authorities We may disclose PI if required by law, for example to law enforcement or other authorities. This includes court orders, subpoenas and orders arising from legal processes, and administrative or criminal investigations. We may also disclose your PI if the disclosure is necessary for the prevention, detection or prosecution of criminal acts or to prevent other damage, or in response to a legal action or to enforce our rights and claims.

We may also share anonymous aggregated usage information with others.

HOW WE STORE AND PROTECT YOUR PERSONAL INFORMATION

Our servers and data centers are located in the U.S and our service providers may be located there and in other countries. By providing us PI, you agree that your PI may be transferred to and stored in these countries. These countries may have different and/or less stringent privacy/data protection and data security rules than those of your own country. As a result, your PI may be subject to access requests from governments, courts, or law enforcement in those countries according to laws in those countries. Subject to the applicable laws of such countries, we will provide the necessary safeguards to maintain protections of your PI, e.g. by obtaining from the PI recipients contractual commitments based on the EU model clauses.

My VIP Travel has a security program intended to keep the PI stored in our systems protected from unauthorized access and misuse. Our systems are configured with data encryption, or scrambling technologies and firewalls constructed to industry standards. We also use Secure Socket Layer (SSL) technology that protects the PI you send over the Internet. PI may only be accessed by persons within our organizations, or our service providers to carry out the uses indicated in this Privacy Policy.

We have put in place appropriate security measures to prevent your PI from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your PI to those employees, agents, contractors and other service providers who have a business need to know. They will only process your PI on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected PI breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

RETENTION PERIODS

We will only retain your PI for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your PI for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for PI, we consider the amount, nature and sensitivity of the PI, the potential risk of harm from unauthorized use or disclosure of your PI, the purposes for which we process your PI and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

If you click through to third party websites or other platforms, My VIP Travel’s privacy policy does not apply.

REQUESTS AND COMPLAINTS

Under certain circumstances set by applicable law, you are entitled to:

Request access to your PI (commonly known as a “data subject access request”). This enables you to receive a copy of the PI we hold about you and to check correctness and integrity of PI. The disclosure might be limited to the 12-month period preceding the receipt of verifiable request. You may also request to furnish you with:

the categories of sources from which PI is collected;

the business or commercial purposes for collecting of PI;

the categories of third parties with whom we share your PI;

the categories of PI we have disclosed for a business purpose.

Request correction of the PI that we hold about you. This enables you to request any incomplete or inaccurate PI to be corrected, though we may need to verify the accuracy of the new PI you provide to us.

Request to delete. You are able to submit a verifiable request and ask us to delete your PI. Please, be aware, there are some cases when we might reject your request.

Request to opt out from PI sales. Such requests shall be submitted through the “Do Not Sell My Personal Information” website. Due to the remote nature of our services, it is important for us to keep communicating through the same email (Verified Email), which was used by you to request a price quote or purchase air tickets and other related services.

The Verified Email is the key communication channel for us, so we can give quick answers and not divulge your data to any malicious person.

You might also a submit request through the voice call, but still we must use the Verified Email to reply, due to law requirements and in order to protect our legal claims.

If you submit your request through the authorized agent or by using third party service we will ask for additional verification by contacting you via Verified Email.

NONDISCRIMINATION

We shall not discriminate (deny services, charge different prices, provide different levels of quality) against you because you exercised any of the rights set herein.

This right might be limited in case, if the difference in prices or levels or quality is reasonably related to the value provided to you by your PI.

We might obtain your opt-in consent and provide to your financial incentives, so you agree to provide additional PI or not to request the deletion of your PI.

Fees and Denials : You will not have to pay a fee to access your PI (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive (more than twice in a 12-month period) or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

We might also refuse to act on your request, when we are not in a position to identify you and verify your request or the requested fee was not paid.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your PI (or to exercise any of your other rights). This is a security measure to ensure that PI is not disclosed to any person who has no right to receive it. We may also contact you (via email, phone or messenger) to ask you for further information in relation to your request to speed up our response.

Due to law limitations we might deny your request to know if you are asking us to disclose a high-risk data (e.g. SSN, driver’s license number, financial account data, passwords etc.). In such cases we will definitely inform you that we have collected such types of information, unless prohibited from doing so by law.

Terms: We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated. The maximum response time shall not exceed 90 days.

HOW My VIP Travel RESPONDS TO “DO NOT TRACK” SIGNALS

Some browsers have a “Do Not Track” feature that lets you tell websites that you do not want to have your online activities tracked. These features are not yet uniform, so we are not currently set up to respond to those signals. My VIP Travel COOKIE POLICY

Technical and strictly necessary Cookies

In most cases our Platforms use cookies in order to ensure technical feasibility to connect our Platform with your device and provide services requested by you. This cookies is integrated by default into our Platforms.

  • Authentication cookies, used for authenticated services, e.g. when You are logging into your online account within any of information systems integrated with our Platform.

Functionality and Preferences Cookies

Such Cookies help us to optimize and make more user-friendly our Platforms, enhance security level, facilitate faster and more convenient use of Platforms, receive valuable statistics in anonymized way, including, but not limited to:

To make aggregated statistics on new visitors to the Platforms.

To help us recognize your browser and its previously configured settings, for example language preferences, font size etc. To manage contractual relationships with partners, when you book on partner websites. To help improve our Platform offering and for capacity planning purposes. We or our service providers may set analytics cookies. These allow us to gather aggregated or segmented information about the types of visitors that access our Platforms and the pages and advertisements that they view. In order to better understand your use of our Platforms, we or our service providers may collect information on such use, including pages visited, links clicked etc. We do not use this information to personally identify you.

In case we are collecting Cookies for statistical purposes, we are committed to apply a “functional separation” principle, so the results of the processing shall be without any negative impact to Your privacy or there should not be any decisions made against You.

Retention period of Functionality Cookies usually is very short. In case of longer periods, please, be aware that we always assess the risk level of such processing, so it does not adversely affect Your privacy.

Under the strict supervision we might allow service providers to collect Functionality Cookies on our Platforms in order to provide us with aggregated statistics. In such cases we require service providers to aggregate or erase data obtained from Your device.

Advertising and Targeting Cookies

We and our third-party vendors, including Google and Facebook, use Advertising cookies to serve ads based on a Your prior visits to our Platforms. For example:

To make use of cross-device tracking in order to optimize our advertising activities. As part of cross-device tracking, My VIP Travel may combine information collected from a particular browser or mobile device with another computer or device linked to the computer or device from which the information was collected. By changing your cookie settings on your device, you can change your cross-device tracking settings for advertising purposes.

To work with online advertising companies to display targeted advertising on our Platforms and third-party platforms that you visit. This targeting may be based on information collected by us or third-party platforms. This targeting may also be based on your activities or behaviors on our Platforms or those of third parties. We may also obtain information about your browsing history from our business partners.

We may use Google Analytics to collect demographic and interest data about you (such as age, gender, and interests), including through Google Analytics Demographics and Interest Reporting. We may use the information collected about you through Google Analytics for Google services such as Remarketing with Google Analytics and Google Display Network Impression Reporting. Choices you make are browser and device specific. Some aspects of our site use cookies to function. You may not be able to use these features if you set your device to block cookies. We anonymize IP addresses in Google Analytics.

We and our advertising partners may also use web beacons (single pixel GIF images). These web beacons are placed in the code of a Web page or an email newsletter. When you access a partner site within our mobile applications, we may track your activity on that site.

OPT-OUT FROM COOKIES

Your browser gives you the ability to control cookies. How to do this varies from browser to browser. You should view the Help menu on the browser you use for further information. Your opt out choice is stored in opt out cookies only in that browser, so you should separately set your preferences for other browsers, computers, or devices you may use. If your browser blocks cookies, your opt out preferences may not be effective. Deleting browser cookies can remove your opt out preferences, so you should visit this page periodically to review your preferences. If you block or delete cookies or opt out of online behavioral advertising, not all of the tracking that we have described in this policy will stop.

Please also note that opting out of a third-party cookie does not mean that you will no longer receive or be subject to online advertising or marketing. It means that the third-party service from which you opted out will no longer deliver ads tailored to your web preferences and online behavioral.

Agreement between you (customer) and My VIP Travel

Welcome to the www.myviptravel.com website (the “Website” or “Site”). This Website is provided solely to assist customers in gathering travel information, determining the availability of travel-related goods and services, making legitimate reservations or otherwise transacting business with travel suppliers, and for no other purposes. The terms “we”, “us”, “our”, “My VIP Travel” refer to a travel agency focusing on the sale of business class air travel to corporate and high-end leisure customers. The term “you” refers to the customer visiting the Website and/or booking a reservation through our customer service agents.

Disputes. The exclusive means of resolving any dispute or claim arising out of or relating to this Agreement (including any alleged breach thereof), the Service, or the Website shall be BINDING ARBITRATION administered by the American Arbitration Association. The one exception to the exclusivity of arbitration is that you have the right to bring an individual claim against the Company in a small-claims court of competent jurisdiction. But whether you choose arbitration or small-claims court, you may not under any circumstances commence or maintain against the Company any class action, class arbitration, or other representative action or proceeding. The arbitrator can grant any relief that a court can, but you should note that arbitration proceedings are usually simpler and more streamlined than trials and other judicial proceedings. Decisions by the arbitrator are enforceable in court and may be overturned by a court only for very limited reasons. Any proceeding to enforce this arbitration agreement, including any proceeding to confirm, modify, or vacate an arbitration award, may be commenced in any court of competent jurisdiction. In the event that this arbitration agreement is for any reason held to be unenforceable, any litigation against the Company (except for small-claims court actions) may be commenced only in the federal or state courts located in San Francisco, California. You hereby irrevocably consent to the jurisdiction of those courts for such purposes. This Agreement, and any dispute between you and the Company, shall be governed by the laws of the state of California without regard to principles of conflicts of law, provided that this arbitration agreement shall be governed by the Federal Arbitration Act. If a suit is brought to enforce any of the provisions of this Agreement, the Service or this Website, the prevailing party shall be paid by the other party all of the prevailing party’s costs and expenses of prosecuting and/or defending the suit, including, without limitation, the reasonable attorneys’ fees, court costs and expenses of the prevailing party. Use of the website / our services

As a condition of your use of this Website / our services, you warrant that: you are at least 18 years of age; you possess the legal authority to create a binding legal obligation; you will use this Website in accordance with these Terms and Conditions; you will only use this Website services to make legitimate reservations for you or for another person for whom you are legally authorized to act; you will inform such other persons about the Terms and Conditions that apply to the reservations/services you have made/ordered on their behalf, including all rules and restrictions applicable thereto; all information supplied by you is true, accurate, current and complete. neither you nor the person you’re buying tickets for are currently subject to any sanctions (economic, financial etc.), administered or enforced from time to time by the EU (its Member States), the United Nations Security Council, the US government, or any other relevant authorities with jurisdiction over you or us from time to time that would prohibit from using our services. We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of these Terms and Conditions.

General Rules and Conditions You accept that you’ll only use our services for personal use and you’ll only book tickets on behalf of yourself or someone you have the permission of. Name changes on tickets are not allowed – only the original passenger can use the ticket(s). Take special note that airline tickets and hotel accommodations and all service fees may not be refundable. If fare rules allow refunds and/or exchanges, a $x (per person) processing fee will be charged in addition to any applicable fees charged by the carrier/provider upon cancellation/exchange. Fees will vary depending on the provider’s terms and conditions. You will not receive a monetary refund when canceling. Instead, you will receive a credit (less any airline/hotel fees) towards a future ticket purchase on long haul international flights of equal or greater value, which will be valid for up to twelve (12) months from your original date of purchase. No-Show tickets cannot be refunded, nor can they be exchanged. Unless the reservation is canceled and the trip rescheduled prior to the original departure date, the ticket is suspended and refunds are not possible. Please check your e-mail frequently for any schedule change notifications from the airline and verify the current flight information 72 hours prior to scheduled departure. The email address you give us must be correct because we’ll use it to send your ticket confirmations and important travel information. Please check that our emails aren’t blocked by your internet service provider or sent to your spam folder. Failure to use any reservation will result in an automatic cancellation of all continuing and return flight reservations and suspension of the tickets. The ticket can be used only in the sequence it was issued. Out of sequence usage is not allowed. The recommended check-in time for all international flights is minimum 3 hours before departure time, even if you are traveling on a domestic flight to another airport to connect to your international flight. Airline tickets are subject to the published conditions of carriage and rules, including but not limited to, cancellation policies of the applicable airline. The contract of carriage in use by the applicable airline, when issued, shall be between the applicable airline and the passenger. Airlines retain the right to adjust flight times and schedules at any time – schedule changes can result in an itinerary that falls outside of contractual agreements. Airlines may also in their discretion change or cancel flights or itineraries. My VIP Travel is not responsible for schedule changes. If your ticket is not honored for any reason, please contact your agent immediately. Your ticket is guaranteed up to the amount paid for the ticket, and My VIP Travel will replace your ticket within 24 hours or offer a full refund, or provide other alternative options within 24 hours. Under consumer legislation, tickets aren’t subject to the right of withdrawal and you have no 14-day “cooling-off period” for bookings.

Access to our website/services doesn’t grant you any intellectual property rights relating to them. You can’t under any circumstance copy, represent, change, transmit, or publish any part of our website or without clear written permission from us. If you do, you may be subject to an infringement action, or another action we feel is appropriate.

Baggage Allowance

Travelers may have to pay additional fees at the airport if their checked items exceed the weight, size or number spelled out in the standard baggage allowance of the airline. Some airlines do not offer any free baggage allowance. Baggage allowance policies and baggage fees associated with checked or carry-on baggage vary widely and are subject to change by the airlines at any time.

Frequent Traveler Points

Frequent traveler awards (miles, points etc.), upgrades, certificate vouchers and other discounts or incentives may not apply to My VIP Travel flights, hotel stays, or other travel services. Additionally, mileage accrual may not apply to all tickets. Please discuss this with your agent for more information.

Supplier Rules and Restrictions

Additional terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select from both airline and hotel suppliers. Please read these additional terms and conditions carefully on the airline or hotel or other accommodation providers websites. You agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. We reserve the right to cancel your booking if full payment is not received in a timely fashion. Some airline or hotel suppliers may require you to present a credit card or cash deposit upon check-in to cover additional expenses incurred during your travel. Such deposit is unrelated to any payment received by My VIP Travel for your booking. You acknowledge that some third-party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such suppliers’ rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result of such violation.

Travel Destinations and Visa Requirements

International travel requires that passengers have in possession a valid Passport, which must be presented for all international flights. Please note that some countries may require a visa and/or a health card. It is passengers’ responsibility to have all required travel documents in possession at check-in. It is strongly recommended that passengers review visa requirements for all stops as some countries may require a transit visa. Passengers transiting via or connecting between airports located in the European Union – Schengen Zone may need a Schengen Entry visa. Please contact the embassy of the country you are going to visit or transit through to get the up-to-date requirements. Some countries have special requirements for one-way travel – it is travelers’ responsibility to make sure they meet eligibility criteria for one-way travel. Visa information is also available at the Travel Advisory Section of the U.S. State Department (phone line: 202-647-5225, official website: www.state.gov). Holders of non-U.S. passports are advised to contact the embassies of their destination and transit countries to obtain entrance requirements.

Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. My VIP Travel urges passengers to review travel prohibitions, warnings, announcements, and advisories issued by the European Union and the United States Government prior to booking travel to international destinations. By offering for sale travel to particular international destinations, myviptravel.com does not represent or warrant that travel to such points is advisable or without risk, and is not liable for damages or losses that may result from travel to such destinations.

Exchanges, Cancellations and Refunds

The confirmed tickets are non-reroutable and non-transferable. If fare rules allow refunds and/or exchanges, a My VIP Travel fee will be charged to process any refund and/or exchange request. This fee will be collected in addition to the penalties charged directly by the airline and/or recalled by the airline from My VIP Travel (recalled commissions). Reservations for tickets to be refunded and/or exchanged must be canceled at least 24 hours prior to scheduled departure time – NO SHOW ticket(s) will not be processed for a refund and/or exchange. All exchanges are subject to fare differences and fare rules applicable on the date of the change. Cancellation of reservation does not automatically initiate a refund. All exchanges can be made only prior to scheduled departure. After the tickets are issued, any changes or refunds are subject to the restrictions of the fares used. Generally speaking, discounted fares are more restrictive and, in many cases, they are non-refundable and non-exchangeable. Please pay attention to the fare restrictions of your tickets. If you need more flexibility with your tickets in terms of refunds and exchanges, please consult your agent and request a less restrictive fare. Airlines offer a wide range of fares, including those that offer exchanges and refunds without any restrictions and penalties. The airlines strictly follow their policies and do not permit exchanges or refunds in case the fare restrictions do not allow it. The airlines determine the restrictions of the fares, and My VIP Travel has no power to override these restrictions. Once the tickets are issued, they are subject to fare restrictions.

Ticket Delivery

All the tickets sold by My VIP Travel are electronic tickets (e-Tickets) and will be sent to the email address provided by you during the booking. Once your electronic tickets are issued, you will receive an email confirmation which will include the ticket number, and the reservation numbers for each airline you’ll be traveling on.

Payment Information

You’re agreeing that the card you pay with is yours (the card holder), or that you have the right to use the payment card if it’s not owned by you. My VIP Travel uses stringent safety measures for credit card payment processing. We accept all major credit cards: Visa, MasterCard, American Express, Diners Club, Discover. Credit card transactions are authorized at the time you or anyone acting on your behalf accepts these Terms & Conditions and continues with the purchase. All credit cards must have a verifiable EU, US, Canadian, UK, Australian, Singapore or other country billing address. When certain transactions are determined to be high risk by our systems, we will not process such transactions unless our credit card verification team has determined that it’s safe to process them. In order to establish validity of such transactions, we may contact you or your bank. Fraudulent transactions, if any, are reported to airport security, airlines and other federal and state law enforcement. Most credit card transactions over the phone to our Client Service Department are recorded and are available as evidence in case of any dispute. If your credit card is declined for any reason, we will notify you within 24 hours. Simply submitting the credit card does not automatically guarantee to ticket. All bookings and fares are not guaranteed until ticketed by the supplier.

Some banks and credit cards impose fees for transactions. Your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the figure shown on the billing summary page for a reservation booked on the Website. In addition, a foreign transaction fee may be assessed if the bank that issued your credit card is located outside of the EU and/or United States. Booking international travel may be considered to be an international transaction by the bank or card company, since My VIP Travel may pass on your payment to an international travel supplier. The currency exchange rate and foreign transaction fee is determined solely by your bank on the day that they process the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your bank.

Limitations of liability

Information contained on the website (including text, graphics, links or other material) are provided on an “as is,” and “where available” basis. My VIP Travel makes no representation or warranty, express or implied, to you or another person or entity as to the accuracy, results, timeliness, completeness, merchantability, fitness for any particular purpose, including but not limited to warranties arising by statute or otherwise in law or from a course of dealing or usage of trade, with respect to the website or any related materials, products, services, or information. Under no circumstances, including, but not limited to negligence, shall we, our providers or distributors, be liable for any damages to, or viruses that may infect, your computer equipment or other property, or any loss of data, on account of your access to, use of, or browsing on the website, or your downloading of any materials, data, text, images, video, audio, or other information from the website or associated with any email or links sent to you by My VIP Travel. In no event shall we, our providers or distributors, be liable for any injury, loss, claim, damage, or any special, punitive, exemplary, direct, indirect, incidental, or consequential damages of any kind (including, but not limited to, lost profits, lost business, or lost savings), whether based in contract, tort, strict liability, or otherwise, that arise out of or are in any way connected with the use, or the inability to use, the website or the services or materials on the website or the travel reservations booked through My VIP Travel call center, even if advised of the possibility of such damages. in no event shall our aggregate liability, or that of our providers or distributors, exceed the total charges set forth in the itinerary giving rise to any such liability.

Any claim or cause of action arising from, or relating to, your access and use of, or purchase of products and/or services from, the website must be communicated beforehand to My VIP Travel in order to reach a mutual agreement. Applicable law may not allow the limitation or exclusion of liability of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Your use of the website shall be at your own risk. We are acting as an intermediary or as an agent for providers of travel-related products and/or services by promoting, selling or accepting reservations or bookings for such products and/or services (such as air transportation, hotel accommodations, meals, travel insurance, etc.) And are in no way liable for such providers’ products and services.

The carriers, hotels and other suppliers providing travel or other services on this website are independent contractors and not agents or employees of the My VIP Travel or its affiliates. My VIP Travel and its company affiliates are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. My VIP Travel and its affiliates have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control, and they have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.

By using the Website and/or our services, you agree to irrevocably waive any claim against My VIP Travel, its subsidiaries or affiliates, and any of such parties’ officers, directors, managers, agents, contractors, or employees, and expressly agree that neither My VIP Travel, nor any of its subsidiaries, affiliates, officers, directors, managers, agents, contractors or employees, shall be held liable for:

Any loss of or damage to property or injury to any person caused by reason of any defect, negligence, or other wrongful act of omission of, or any failure of performance of any kind by any Travel Supplier; any inconvenience, loss of enjoyment, mental distress or other similar matter; any delayed departure, missed connections, substitutions of accommodations, terminations of service, or changes in fares and rates; any cancellation or double-booking of reservations or tickets beyond the reasonable control of My VIP Travel,; and any claim of any nature arising out of or in connection with air or other transportation services, products or other features performed (or not) or occurring (or not) in connection with your itinerary.

For the avoidance of doubt (and without limiting the foregoing), My VIP Travel does not assume any liability whatsoever for canceled flights, flights that are missed, or flights not connecting due to any scheduled changes made by the relevant airline.

The limitations specified in these Terms & Conditions shall survive and apply even if any limited remedy specified in these Terms & Conditions is found to have failed of its essential purpose. The limitations of liability provided in these Terms & Conditions inure to the benefit of My VIP Travel, its affiliates, and the suppliers of travel products and services purchased through our Website.

Resolution of Disputes

Customer satisfaction is the foundation of our success. That’s why, if a dispute arises between us, our goal is to resolve the dispute quickly in a fair and cost-effective way. Accordingly, you agree to give us an opportunity to resolve any disputes or claims relating in any way to the Website, any dealings with our customer service agents, any services or products provided, any representations made by us by contacting My VIP Travel Customer Support at +xxx or xx@xx.com or submitting a claim via an online form at Contact Us so that we have an opportunity to try to address your concerns.

Indemnification You agree to protect and indemnify My VIP Travel, its affiliates, partners, joint ventures and/or their respective suppliers and any of their respective officers, directors, managers, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by:

you or on your behalf in excess of the liability described above; by third parties as a result of your breach of these Terms & Conditions, notices or documents referenced on the Website; your violation of any law or the rights of a third party; or your use of the Website. Warsaw Convention and Montreal Convention Passengers on a journey involving an ultimate destination or a stop in a country other than the country of departure are advised that international treaties known as the Montreal Convention, or its predecessor, the Warsaw Convention, including its amendments (the Warsaw Convention system), may apply to the entire journey, including any portion thereof within a country. For such passengers, the applicable treaty, including special contracts of carriage embodied in any applicable tariffs, governs and may limit the liability of the carrier.

Notice of liability limitations The Montreal Convention or the Warsaw Convention system may be applicable to your journey and these Conventions govern and may limit the liability of air carriers for death or bodily injury, for loss of or damage to baggage, and for delay.

Where the Montreal Convention applies, the limits of liability are as follows: There are no financial limits in respect of death or bodily injury. In respect of destruction, loss of, or damage or delay to baggage, 1,100 Special Drawing Rights (approximately EUR 1,300; US $1,700) per passenger in most cases. For damage occasioned by delay to your journey, 4,694 Special Drawing Rights (approximately EUR 5,400; US $7,100) per passenger in most cases. EC Regulation No. 889/2002 requires European Community carriers to apply the provisions of the Montreal Convention limits to all carriage by them of passengers and their baggage by air. Many non-European Community carriers have elected to do so in respect of the carriage of passengers and their baggage.

Where the Warsaw Convention system applies, the following limits of liability may apply: 16,600 Special Drawing Rights (approximately EUR 20,000; US $20,000) in respect of death or bodily injury if the Hague Protocol to the Convention applies, or 8,300 Special Drawing Rights (approximately EUR 10,000; US $10,000) if only the Warsaw Convention applies. Many carriers have voluntarily waived these limits in their entirety, and US regulations require that, for journeys to, from or with an agreed stopping place in the US, the limit may not be less than US $75,000. 17 Special Drawing Rights (approximately EUR 20; US $20) per kg for loss of or damage or delay to checked baggage, and 332 Special Drawing Rights (approximately EUR 400; US $400) for unchecked baggage. The carrier may also be liable for damage occasioned by delay. Further information may be obtained from the carrier as to the limits applicable to your journey. If your journey involves carriage by different carriers, you should contact each carrier for information on the applicable limits of liability. Regardless of which Convention applies to your journey, you may benefit from a higher limit of liability for loss of, damage or delay to baggage by making at check-in a special declaration of the value of your baggage and paying any supplementary fee that may apply. Alternatively, if the value of your baggage exceeds the applicable limit of liability, you should fully insure it before you travel. Time limit for action: Baggage claims: Written notice to the carrier must be made within 7 days of the receipt of checked baggage in the case of damage, and, in the case of delay, within 21 days from the date on which it was placed at the disposal of the passenger.

Notice of Contract Terms Incorporated by Reference Your contract of carriage with the carrier that provides you with carriage by air, whether international, domestic or a domestic portion of an international journey is subject to this notice; to any notice or receipt of the carrier; and to the carriers individual terms and conditions (Conditions), related rules, regulations and policies (Regulations) and any applicable tariffs. If your carriage is by more than one carrier, different Conditions, Regulations and any applicable tariffs may apply for each carrier. The Conditions, Regulations and any applicable tariffs of each carrier are, by this notice, incorporated by reference into and made part of your contract of carriage. The Conditions may include, but are not restricted to: Conditions and limits on the carriers liability for the bodily injury or death of passengers. Conditions and limits on the carriers liability for the loss of, damage to or delay of goods and baggage, including fragile or perishable goods. Rules for declaring a higher value for baggage and for paying any supplementary fee that may apply. Application of the carriers Conditions and limits of liability to the acts of the carriers agents, servants and representatives, including any person providing either equipment or services to the carrier. Claims restrictions, including time limits by which passengers must file claims or bring actions against the carrier. Rules about reconfirmations or reservations; check in times; the use, duration and validity of air transportation services; and the carrier’s’ right to refuse carriage. Rights of the carrier to refuse carriage to passengers who fail to comply with applicable laws or who fail to present all necessary travel documents. You can obtain more information about your contract of carriage, and find out how to request a copy, at places where transportation on the carrier is sold. Many carriers also have this information on their websites. When required by applicable law, you have the right to inspect the full text of your contract of carriage at the carriers airport and sales offices, and upon request, to receive a copy by mail or other delivery service from each carrier free of charge. If a carrier sells air transportation services or checks baggage specifying carriage on another carrier, it does so only as agent for the other carrier.

DENIED BOARDING

Airline flights may be overbooked, and there is a slight chance that a seat will not be available on a flight for which a person has a confirmed reservation. If the flight is overbooked, no one will be denied a seat until airline personnel first ask for volunteers willing to give up their reservation in exchange for compensation of the airlines choosing. If there are not enough volunteers, the airline will deny boarding to other persons in accordance with its particular boarding priority. The complete rules for the payment of compensation and each airlines boarding priorities are available at all airport ticket counters and boarding locations. Some airlines do not apply these consumer protections to travel from some foreign countries, although other consumer protections may be available. Check with your airline or your travel agent. BAGGAGE : Excess valuation may be declared on certain types of articles. Carriers may apply special rules for fragile, valuable, or perishable articles. Check with your carrier. Checked Baggage: Carriers may permit a free checked baggage allowance, which is set by the carrier and may differ by class, and/or route. Carriers may apply extra charges for checked baggage in excess of their permitted allowance. Check with your carrier. Cabin (Unchecked) Baggage: Carriers may permit a free cabin baggage allowance, which is set by the carrier and may differ by class, route, and/or aircraft type. It is recommended that cabin baggage be kept to a minimum. Check with your carrier. If more than one carrier is providing the transportation for your journey, each carrier may apply different rules on baggage (both checked and cabin).

CHECK-IN TIMES

The time shown on the itinerary/receipt is the departure time of the aircraft. Flight departure time is not the same as the time you must check-in or the time you must be available for boarding. Your carrier may refuse you carriage if you are late. Check-in times, as advised by your carrier, are the latest times at which passengers can be accepted for travel; boarding times, as advised by your carrier, are the latest times at which passengers must present themselves for boarding.

DANGEROUS GOODS (HAZARDOUS MATERIALS)

For safety reasons, dangerous goods must not be packed in checked or cabin (unchecked) baggage except as specifically permitted. Dangerous goods include but are not limited to: compressed gases, corrosives, explosives, flammable liquids and solids, radioactive materials, oxidizing materials, poisons, infectious substances, and briefcases with installed alarm devices. For security reasons, other restrictions may apply. Check with your carrier.

COVID-19 WAIVER OF LIABILITY

You agree that it is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. We assume no responsibility for and shall not be liable for unsafe conditions or health hazards including pandemics or other illnesses. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on “Find International travel Information” then click on “Country Information”, and fill in the name of the destination country.
